What is Third Party Debt Orders?
A Third Party Debt Order (formerly known as a Garnishee Order) freezes money held by a third party — typically a bank — on behalf of the debtor and redirects it to the creditor.
It is most commonly used to freeze and recover funds held in the debtor's bank account, making it a powerful enforcement tool where the debtor has money in the bank but is refusing to pay.

How Third Party Debt Orders Works
Obtain a CCJ
A Third Party Debt Order can only be applied for after a County Court Judgement has been obtained.
Apply for Interim Order
The creditor applies to the court for an interim Third Party Debt Order, which freezes the funds.
Bank Notified
The bank is notified and freezes the funds in the debtor's account up to the value of the debt.
Final Order
If the debtor does not object, the court makes a final order directing the bank to pay the funds to the creditor.
Eligibility Requirements
- A County Court Judgement (CCJ) must already exist
- The debtor must have funds held by a third party (e.g. a bank)
- The funds must be sufficient to cover the debt
Limitations & Considerations
- Only effective if the debtor has funds in the account
- The debtor may move funds before the order is served
- Joint accounts may be partially protected
